Must be hard to be a critic, always looking for the negative.
Anyways, I really enjoyed the movies and in my opinion, the reason why some people thinks that The Dark Knight is better than TDKR is because of Heath Ledger. Sure Tom Hardy didnt deliver the performance Ledger gave, but he tried.
I say TDKR is the best in the trilogy, especially the ending.

Whew! For a second there I thought you were talking about Joseph Gordon Levitt's character who was one of my favorite things about the film and really served as an avatar for the audience with Bruce Wayne being absent from the action for such a large portion of the movie. As for the guy you're talking about, I don't remember the character's name, but the actor is Mathew Modine who I've always liked and I think did a decent job with what little he was given. However, I didn't like the character (total douche) and I didn't buy his suddenly showing up and being heroic at the ending. If they hadn't already given Selina Kyle her moral confliction scene (her being seconds away from escaping on the Batpod, but not quite sure if she should) they could have given one to Modine's character. Maybe have him looking at his uniform trying to decide what he should do. It would have made his standing alongside the other cops at the ending much easier to swallow.

In response to your points some SPOILERS...
1) It would be easy to assume that in the year between BB and TDK Bruce would have amassed enough injuries and abuse that it would add up quickly. We are talking about getting blows from crowbars and baseball bats for almost a year. Plus he wasn't prepared for the landing of the fall in TDK. If you have ever taken a nasty fall you just didn't land right in a sport, for example, that can mess you up for a long time.
2) Like you said, thats personal preference. I was fine with just seeing how the Joker's action influenced Gotham years down the road. There was really no need to reference him.
3) If you watch BB when Bruce first arrives at the LoS in the mountains there are members with guns dressed just like those in TDKR. Plus just like any organization it is safe to say that with new leadership and time the LoS evolved in some way for their new mission.
As far as adding new characters to the franchise I think we already had more than enough to follow. My only gripe was those two greedy corporate guys could have been cut out or reduced to one guy. Also that new Police guy (not sure his name) wasn't really needed or else they could have developed his character more. Making the film into a showcase of Batman villains would've been silly and distracting to the extreme.
