Well, he IS Captain America. Therefore he'd use his superpower of international negotiating by appealing to a powerful foreign demographic(aka, Superman) by including new policies and deregulations over super-humans in America, like himself. The bill would be passed, of course, as long as Superman laser-beamed Batman's ass, when he least expects it, as part of holding his end of the deal.
Captain America wins, without ever having to slip on the spandex.
